Terms of Service

The terms that apply to our pool services, quotes, scheduling, payment and warranties.

Effective October 14, 2026

These terms explain what you can expect from Pool Guys Midsouth and what we need from you. We have tried to write them in plain language rather than legalese.

1. Agreement to these terms

These Terms of Service ("Terms") apply to your use of poolguysmidsouth.com and to the pool and spa services provided by Pool Guys Midsouth ("Pool Guys Midsouth," "we," "us," or "our"). By using our website, requesting a quote, or accepting service from us, you agree to these Terms.

If we give you a written quote, work order or service agreement, the terms in that document apply to that work and control if they conflict with anything here.

2. Our services

We provide swimming pool and spa services in the Memphis area, including weekly maintenance, pool openings and closings, liner replacement, drain and clean, deck repairs, lighting, and related repairs.

We are not a licensed engineer, inspector, electrician or plumber unless we tell you otherwise in writing for specific work. Some repairs require a licensed trade, and we will tell you when that is the case.

3. Quotes and estimates

Quotes are based on the information you give us and on what we can see at the time. Pool work regularly uncovers conditions that were not visible — a failed line beneath a deck, corroded equipment, a liner that tears when drained, or a structural problem under the surface.

If we find something that changes the price or the scope, we will stop and tell you before continuing. We will not perform additional billable work without your approval.

Unless the quote says otherwise, a quote is valid for 30 days. Prices may change if material costs change materially before work begins.

4. Scheduling and access

Weekly service is performed on a regular route, so the exact time of day may vary. Weather, water conditions and emergencies can move a visit.

To do our work we need safe, unobstructed access to your pool, equipment pad and water supply on your scheduled day. Please make sure gates are unlocked or we have the code, and that pets are secured.

If we cannot access your pool on a scheduled visit, we may have to skip the visit, and the visit may still be billable. If you need to cancel or reschedule, let us know at least 24 hours in advance where you can.

5. Your responsibilities as a pool owner

  • Keep the pool filled to the proper water level between visits
  • Keep electricity and water to the equipment on and functioning
  • Run your pump and filter for the hours we recommend for the season
  • Tell us promptly about leaks, equipment noises, cloudy water or anything unusual
  • Keep the area around the equipment pad clear and safe to work in
  • Secure pets and tell us about anything on the property we should know about

Water chemistry depends heavily on circulation and run time. If equipment is off or the water level drops, chemistry can move quickly between visits and the results of our service will suffer.

6. Payment

Weekly and monthly service is billed on a recurring basis. Repairs, installations and project work are billed as described in the quote, which may include a deposit before materials are ordered.

Invoices are due on the date shown on the invoice. If an account goes unpaid, we may pause service until the balance is current, and we may charge a late fee or interest where the law allows.

Deposits on ordered materials may be non-refundable once the materials have been ordered or cut to size, because they cannot be returned.

7. Cancelling recurring service

Either of us can end recurring service with reasonable notice — we ask for at least seven days before your next scheduled visit. You are responsible for service already performed and for any materials already ordered for you.

We may end service if an account stays unpaid, if the property is unsafe to work in, or if the pool’s condition makes the agreed service impractical.

8. Warranty on our work

We stand behind our workmanship. If something we installed or repaired fails because of how we did the work, tell us and we will come back and make it right.

Equipment and materials carry the manufacturer’s warranty, not ours. We will help you make a manufacturer claim, but the manufacturer’s terms govern it.

Our workmanship warranty does not cover normal wear, damage from weather, freeze damage, improper water chemistry or run time between our visits, damage caused by someone else working on the pool, pre-existing structural problems, or work performed on equipment that was already failing and that you asked us to service anyway.

9. Water chemistry and safety

Pool chemicals are hazardous. Keep them stored safely and away from children and pets, and do not mix them. If we leave chemicals on site at your request, you are responsible for storing them safely.

Swimming pools carry an inherent risk of drowning and injury. We service pools; we do not supervise them. Keeping your pool safely enclosed, gated and supervised is your responsibility as the owner, and local codes may require specific barriers and alarms.

10. Limitation of liability

To the fullest extent the law allows, Pool Guys Midsouth is not liable for indirect, incidental, special or consequential damages, including loss of use of your pool.

Our total liability for any claim relating to our services is limited to the amount you paid us for the specific service that gave rise to the claim.

Nothing in these Terms limits liability that cannot be limited by law, including liability for our own gross negligence or willful misconduct.

11. Photographs and service records

We photograph pools, equipment and work areas to document condition, support quotes and warranty claims, and maintain your service record. We will not use a photograph of your property in our marketing without your permission.

Inspection and service reports we send you are for your own use. How we handle this information is described in our Privacy Policy.

12. Website use

The content, images, logos and layout of this website belong to Pool Guys Midsouth and may not be copied or reused without our permission.

Information on the site is provided for general guidance about our services. It is not a professional diagnosis of your pool. Please do not rely on it in place of having us look at your pool.

13. Governing law and disputes

These Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts serving Shelby County, Tennessee, and both of us consent to that venue.

Before filing anything, please contact us directly. Nearly every dispute we have seen was resolved with a phone call.

14. Changes to these terms

We may update these Terms. The current version is always posted here with its effective date. Continuing to use our website or accept our services after a change means you accept the updated Terms.
